Charges Against Man Dismissed After 22 Years of Incarceration

A Connecticut Judge has dismissed all murder and rape charges against Kenneth Ireland, a man who spent more than 20 years behind bars for a crime that DNA evidence proves he didn’t commit.

“Ireland was 20 years old when he was sentenced to 50 years in prison for the 1986 rape and murder of Barbara Pelkey, a mother of four. Her nude body was found at the Wallingford manufacturing plant where she worked alone at night.”

“Prosecutors say they have reopened the investigation into her death.”

Connecticut Lawyer Held Hostage by Husband

A Hartford, Connecticut lawyer by the name of Nancy Tyler was held hostage by her former husband yesterday for 12 hours, in what will hopefully be the last episode in their messy divorce case. Before the standoff was done, the advertising executive ex-husband set flames to the home they built together.

“An advertising executive who snatched his ex-wife from a parking lot, held her hostage for hours during a standoff with police and then refused to leave their burning family home finally surrendered when flames made their way to the basement where he was hiding, authorities said. “

Richard Shenkman  was transported by ambulance from the fire-gutted remains of his and his ex-wifes’ home, to the police station where he will be charged with at least kidnapping and arson. More charges could follow.

“The dramatic ending came more than 12 hours after police said Shenkman missed a Tuesday morning court hearing in his contentious divorce and abducted Tyler from a lot in downtown Hartford.”

“Shenkman kept police at bay for hours by saying he had booby-trapped the house with explosives. Tyler escaped Tuesday night, and police cut power to the suburban Hartford neighborhood of well-maintained homes amid several dozen gunshots and explosions. A fire ignited and quickly engulfed the house as police urged Shenkman to come out.”

Supreme Court Backs Firefighters in Reverse-Discrimination Suit

Today the U.S. Supreme Court sided with white firefighters in a workplace discrimination lawsuit. The case is at the center of affirmative action and the role race should play in job advancement.

The court ruled that the city of  New Haven, Connecticut, was wrong to trash a promotions exam because no African-Americans and only two Hispanic firefighters had a chance to be made lieutenants or captains based on the tests results.

The city said that it had acted and threw out the test to avoid a lawsuit from minorities.

“Fear of litigation alone cannot justify an employer’s reliance on race to the detriment of individuals who passed the examinations and qualified for promotions.”

“The Supreme Court was being asked to decide whether there was a continued need for special treatment for minorities, or whether enough progress has been made to make existing laws obsolete, especially in a political atmosphere in which an African-American occupies the White House.”

At issue was whether or not the city intentionally discriminated against white fire fighters — in violation of both federal law and the Constitution’s Equal Protection Clause.

“The city rejected the test results solely because the higher scoring candidates were white,” wrote Justice Anthony Kennedy for the majority. “Fear of litigation alone cannot justify an employer’s reliance on race to the detriment of individuals who passed the examinations and qualified for promotions.”

All of the judges didn’t see eye to eye though.

“In dissent, Justice Ruth Bader Ginsburg said the white firefighters “understandably attract this court’s sympathy. But they had no vested right to promotion. Nor have other persons received promotions in preference to them.”

“Relying so heavily on pencil-and-paper exams to select firefighters is a dubious practice,” Ginsburg said, calling the majority ruling “troubling.”

“Congress endeavored to promote equal opportunity in fact, and not simply in form. The damage today’s decision does to that objective is untold,” she said.

Same-Sex Adoption: The Wave of the Future?

We are hearing more and more about same-sex couples getting hitched in the state of California. Although it was recently made legal, protesters pushed for the issue to go on the November ballot. Voting as to whether a same-sex couple has the right to wed, in my opinion, seems pretty “stone age.” Why the majority has the right to decide if a same sex couple marries is absurd. Shouldn’t it be up to the actual couple? Just like the abortion issue, I think that if you are against it, don’t do it. However, you really shouldn’t be allowed to dictate what others do, regardless of your beliefs.

While Cali is about to come face to face with the same-sex marriage issue, there is also a debate across the country as to whether or not a same-sex couple has the right to adopt a child. In most states, they don’t…yet! However, in Connecticut, same-sex couples are now eligible for adoption and that’s something to celebrate. Legal recognition for both parents have been gained and my hope is that other states will soon follow. Just like when segregation laws collapsed, times are changing and people are being asked to open their minds and hearts, allowing the transformation of a new idea, which gives those who are “different,” equal rights that offer the chance at a happily ever after.
