Virginia doesn’t mess around when it comes to their anti-spam law, which is widely known as the strictest in the country. And when the Spammer king, Jeremy Jaynes, was busted for sending junk e-mails to unsuspecting victims, the Virginia Supreme Court put the crackdown.
As prosecutors presented evidence of 53,000 illegal e-mails sent in July 2003, and authorities claimed that they believe Jaynes sent 10 million e-mails a day, grossing up to $750,000 per month, the Court ruled that Jaynes’ earnings are going to come to a screeching halt.
Sentenced to nine years in jail, Jaynes is under house arrest as he appeals the conviction. In Jaynes’ eyes, he should be protected by the First Amendment and states that his sentence is “unconstitutional.â€
Call me crazy but while spam is undeniably a serious nuisance, pedophiles get a much lighter sentence for a much more serious crime. So, where’s the justice? You tell me.

Call me crazy but I don’t think it’s a coincidence that the state with the most aggressive spam penalties is also the home of AOL’s headquarters. I wouldn’t imagine that a corporation could influence the law though (insert sarcasm here).
